  • Access Means the making available of facilities and/or services, to another undertaking, under defined conditions, on either an exclusive or non-exclusive basis, for the purpose of providing electronic communications services. It covers inter alia: access to network elements and associated facilities, which may involve the connection of equipment, by fixed or non-fixed means (in particular this includes access to the local loop and to facilities and services necessary to provide services over the local loop), access to physical infrastructure including buildings, ducts and masts; access to relevant software systems including operational support systems, access to number translation or systems offering equivalent functionality, access to fixed and mobile networks, in particular for roaming, access to conditional access systems for digital television services; access to virtual network services (Article 2(a) Directive 2002/19/EC).
  • Access Control A mechanism granting access to data or resources following authenticated identification (Article 2(7) Royal Decree 994/1999, repealed by Royal Decree 1720/2007).
  • Addressee of a Data Message Means a person who is intended by the originator to receive the data message, but does not include a person acting as an intermediary with respect to that data message (Article 2(d) UNCITRAL Model Law on Electronic Commerce).
  • Addressee of an Electronic Communication Means a party who is intended by the originator to receive the electronic communication, but does not include a party acting as an intermediary with respect to that electronic communication (Article 4(e) United Nations Convention on the Use of Electronic Communications in International Contracts).
  • Advanced Electronic Signature Means an electronic signature which meets the following requirements: (a) it is uniquely linked to the signatory; (b) it is capable of identifying the signatory; (c) it is created using means that the signatory can maintain under his sole control; and (d) it is linked to the data to which it relates in such a manner that any subsequent change of the data is detectable (Article 2(2) Directive 1999/93/EC).
  • Application Program Interface (API) Means the software interfaces between applications, made available by broadcasters or service providers, and the resources in the enhanced digital television equipment for digital television and radio services (Article 2(p) Directive 2002/21/EC).
  • Assignment or Communication of Data Any disclosure of data to a person other than the data subject (Article 3(i) Organic Law 15/1999).
  • Assignment or Communication of Data (Royal Decree 1720/2007) Processing that implies disclosing the data to a person other than the data subject (Article 5.1.c Royal Decree 1720/2007).
  • Associated Facilities Means those facilities associated with an electronic communications network and/or an electronic communications service which enable and/or support the provision of services via that network and/or service. It includes conditional access systems and electronic programme guides (Article 2(e) Directive 2002/21/EC).
  • Authentication Procedure for checking a user’s identity (Article 5.2.b Royal Decree 1720/2007).
  • Authentication (Regulation (EC) Nº 460/2004) Means the confirmation of an asserted identity of entities or users (Article 4(e) Regulation (EC) Nº 460/2004).
  • Authentication (Royal Decree 994/1999) A procedure for verifying a user's identity (Article 2(6) Royal Decree 994/1999, repealed by Royal Decree 1720/2007).
  • Authorised Access Authorisation granted to a user to use the various resources (Article 2(4) Royal Decree 994/1999, repealed by Royal Decree 1720/2007).
  • Authorised Access (Royal Decree 1720/2007) Authorisations granted to a user to use the various resources. If appropriate, these shall include authorisations or functions of a user delegated by the data controller or the security officer (Article 5.2.a Royal Decree 1720/2007).
  • Automated Data File Means any set of data undergoing automatic processing (Article 2(b) article Convention 108).
  • Automated Message System Means a computer program or an electronic or other automated means used to initiate an action or respond to data messages or performances in whole or in part, without review or intervention by a natural person each time an action is initiated or a response is generated by the system (Article 4(g) United Nations Convention on the Use of Electronic Communications in International Contracts).
  • Automatic Processing Includes the following operations if carried out in whole or in part by automated means: storage of data, carrying out of logical and/or arithmetical operations on those data, their alteration, erasure, retrieval or dissemination (Article 2(c) article Convention 108).
  • Availability Means that data is accessible and services are operational (Article 4(d) Regulation (EC) Nº 460/2004).
