  • Electronic Communication Means any communication that the parties make by means of data messages (Article 4(b) United Nations Convention on the Use of Electronic Communications in International Contracts).
  • Electronic Communications Network (Directive 2002/21/EC) Means transmission systems and, where applicable, switching or routing equipment and other resources which permit the conveyance of signals by wire, by radio, by optical or by other electromagnetic means, including satellite networks, fixed (circuit- and packet-switched, including Internet) and mobile terrestrial networks, electricity cable systems, to the extent that they are used for the purpose of transmitting signals, networks used for radio and television broadcasting, and cable television networks, irrespective of the type of information conveyed (Article 2(a) Directive 2002/21/EC).

  • Electronic Communications Service (Directive 2002/21/EC) Means a service normally provided for remuneration which consists wholly or mainly in the conveyance of signals on electronic communications networks, including telecommunications services and transmission services in networks used for broadcasting, but exclude services providing, or exercising editorial control over, content transmitted using electronic communications networks and services; it does not include information society services, as defined in Article 1 of Directive 98/34/EC, which do not consist wholly or mainly in the conveyance of signals on electronic communications networks (Article 2(c) Directive 2002/21/EC).
  • Electronic Communications Service (Directive 2002/77/EC) A service normally provided for remuneration which consists wholly or mainly in the conveyance of signals on electronic communications networks, including telecommunications services and transmission services in networks used for broadcasting but exclude services providing or exercising editorial control over, content transmitted using electronic communications networks and services; it does not include information society services as defined in Article 1 of Directive 98/34/EC which do not consist wholly or mainly in the conveyance of signals on electronic communications networks (Article 1(3) Directive 2002/77/EC).
  • Electronic Data Interchange (EDI) Means the electronic transfer from computer to computer of information using an agreed standard to structure the information (Article 2(b) UNCITRAL Model Law on Electronic Commerce).
  • Electronic Mail Means any text, voice, sound or image message sent over a public communications network which can be stored in the network or in the recipient's terminal equipment until it is collected by the recipient (Article 2(h) Directive 2002/58/EC).
  • Electronic Money Means monetary value as represented by a claim on the issuer which is: (i) stored on an electronic device; (ii) issued on receipt of funds of an amount not less in value than the monetary value issued; (iii) accepted as means of payment by undertakings other than the issuer (Article 1(3)(b) Directive 2000/46/EC).
  • Electronic Money Institution Means an undertaking or any other legal person, other than a credit institution as defined in Article 1, point 1, first subparagraph (a) of Directive 2000/12/EC which issues means of payment in the form of electronic money (Article 1(3)(a) Directive 2000/46/EC).
  • Electronic Payment Means any payment transaction carried out by means of a card incorporating a magnetic strip or microcircuit used at an electronic payment terminal (EPT) or point-of-sale (POS) terminal. The Code does not cover: - 'company-specific' cards not covered by the above definition, - cards serving purposes other than direct or deferred payment, - payments by cheque with bank-card guarantee, - payments by card using mechanical processes (invoice slips) (Point II(1) Commission Recommendation 87/598/EEC).
  • Electronic Services and Electronically Supplied Services Means the services referred to in point (k) of Article 56(1) (Article 358(2) Directive 2006/112/EC).
  • Electronic Signature (Directive 1999/93/EC) Means data in electronic form which are attached to or logically associated with other electronic data and which serve as a method of authentication (Article 2(1) Directive 1999/93/EC).
  • Electronic Signature (UNCITRAL Model Law) Data in electronic form in, affixed to or logically associated with, a data message, which may be used to identify the signatory in relation to the data message and to indicate the signatory's approval of the information contained in the data message (Article 2(a) UNCITRAL Model Law on Electronic Signatures).
  • Electronic-signature Product Means hardware or software, or relevant components thereof, which are intended to be used by a certification-service-provider for the provision of electronic-signature services or are intended to be used for the creation or verification of electronic signatures (Article 2(12) Directive 1999/93/EC).
  • End-user Means a user not providing public communications networks or publicly available electronic communications services (Article 2(n) Directive 2002/21/EC).
  • Enhanced Digital Television Equipment Means set-top boxes intended for connection to television sets or integrated digital television sets, able to receive digital interactive television services (Article 2(o) Directive 2002/21/EC).
  • Erasure Procedure through which the data controller stops using data. Erasure shall imply data being blocked, comprising their identification and retention in order to prevent processing with the exception of being at the disposal of public administrations, judges and courts for the purpose of determining any liability arising from processing, and only for the duration of such liability. On the expiry of such term, the data shall be deleted (Article 5.1.b Royal Decree 1720/2007).
  • Established Service Provider A service provider who effectively pursues an economic activity using a fixed establishment for an indefinite period. The presence and use of the technical means and technologies required to provide the service do not, in themselves, constitute an establishment of the provider (Article 2(c) Directive 2000/31/EC).
  • Exclusive Rights Means the rights that are granted by a Member State to one undertaking through any legislative, regulatory or administrative instrument, reserving it the right to provide an electronic communications service or to undertake an electronic communications activity within a given geographical area (Article 1(5) Directive 2002/77/EC).
  • Exporter of Personal Data The natural person or legal entity, public or private, or administrative body situated in Spanish territory that carries out, pursuant to the provisions herein, a transfer of personal data to a third country (Article 5.1.j Royal Decree 1720/2007).
  • Extraction Means the permanent or temporary transfer of all or a substantial part of the contents of a database to another medium by any means or in any form (Article 7(2)(a) Directive 96/9/EC).
