  • Management of Copyright and Related Rights for the Provision of Legitimate Online Music Services at Community Level Means the provision of the following services: the grant of licences to commercial users, the auditing and monitoring of rights, the enforcement of copyright and related rights, the collection of royalties and the distribution of royalties to right-holders (Point 1(a) Commission Recommendation 2005/737/EC).
  • Means of Distance Communication (Directive 2002/65/EC) Refers to any means which, without the simultaneous physical presence of the supplier and the consumer, may be used for the distance marketing of a service between those parties (Article 2(e) Directive 2002/65/EC).
  • Means of Distance Communication (Directive 97/7/EC) Means any means which, without the simultaneous physical presence of the supplier and the consumer, may be used for the conclusion of a contract between those parties. An indicative list of the means covered by this Directive is contained in Annex I (Article 2(4) Directive 97/7/EC).
  • Medium A physical object likely to be processed in an information system and on which data may be recorded or from which they may be retrieved (Article 2(10) Royal Decree 994/1999, repealed by Royal Decree 1720/2007).
  • Member State of Consumption Means the Member State in which, pursuant to Article 57, the supply of the electronic services is deemed to take place (Article 358(4) Directive 2006/112/EC).
  • Member State of Identification Means the Member State which the non-established taxable person chooses to contact to state when his activity as a taxable person within the territory of the Community commences in accordance with the provisions of this Chapter (Article 358(3) Directive 2006/112/EC).
  • Multi-territorial Licence Means a licence which covers the territory of more than one Member state (Point 1(d) Commission Recommendation 2005/737/EC).
  • Musical Works Means any musical work or other protected subject matter (Point 1(b) Commission Recommendation 2005/737/EC).
  • Mutual Jurisdiction Means a court jurisdiction at the location of either (a) the principal office of the Registrar (provided the domain-name holder has submitted in its Registration Agreement to that jurisdiction for court adjudication of disputes concerning or arising from the use of the domain name) or (b) the domain-name holder's address as shown for the registration of the domain name in Registrar's Whois database at the time the complaint is submitted to the Provider (Point 1 Rules for UDRP).
